New Guidelines on the scope of the AML Law for Directors

ILA has been involved for the last year in regular discussions with various authorities about the scope of the AML Law and notably whether or not Directors are within such scope. On this topic, the ILA AML Taskforce together with the Ministry of Justice have the pleasure of organising a live presentation and discussion on the new Guidelines published by the Ministry of Justice on 29 October 2021. 

These Guidelines are the outcome of the works performed by a working committee coordinated by the Ministry of Justice on Trust and Company service Providers (TCSPs) of the National Prevention Committee. The Guidelines include a number of situations under which a person may operate as a member of a Board of Directors. They also provide for a (non-exhaustive) list of examples of common standard situations allowing to assess whether or not such person qualifies as a TCSP or not. Each Director should of course assess their individual set-up on a case-by-case basis.
